# Terms of Service

Last Updated: October 24, 2026

Welcome to CustomsGuard.
By accessing or using our compliance dashboard, REST API, or model orchestrator integrations, you agree to these Terms of Service.

## 1. Description of Service
CustomsGuard provides an autonomous international trade compliance and tariff discrepancy engine.
The platform cross-references commercial documents against published HS tariff schedules, calculates estimated duty differentials, estimates container demurrage and detention liabilities (e.g., official CMA CGM Indonesia published tariff matrices), and checks mandatory import permit schedules (including SDPPI, Kemenkes, and BPOM).

## 2. Human-in-the-Loop Advisory Standard
* CustomsGuard serves an advisory, analytical, and risk-mitigation function.
* All calculations, tariff discrepancy flags, and demurrage projections are generated to assist licensed trade compliance professionals and customs brokers.
* The Platform does not replace official customs brokers or legal counsel.
* Final declaration, duty submission, and cargo clearance authorization remain the sole legal responsibility of the licensed human compliance officer or importer of record.

## 3. Acceptable Use
You agree not to use CustomsGuard to:
* Attempt fraudulent circumvention of lawful customs duties or mandatory regulatory licenses.
* Submit forged or falsified commercial manifests.
* Interfere with, overburden, or reverse-engineer the underlying API or container network.

## 4. Limitation of Liability
* CustomsGuard derives tariff calculations and demurrage projections from published schedules and customer-supplied shipment parameters.
* We make reasonable efforts to maintain current regulatory schedules; however, port authority adjustments, fluctuating terminal handling surcharges, or statutory tariff updates may occur.
* To the fullest extent permitted by applicable law, CustomsGuard and its operators shall not be liable for port detention penalties, customs fines, demurrage surcharges, or release delays arising from inaccurate invoice inputs or official customs discretion.

## 5. Audit Evidence and Exported Records
Audit dossiers generated in Markdown or JSON format represent technical findings based on declared input parameters.
Users are responsible for verifying export files prior to presenting them as audit evidence to customs authorities or insurance carriers.

## 6. Updates to Terms
We reserve the right to revise these Terms of Service as international trade regulations and system functionality evolve.
Continued usage of the Platform constitutes agreement to any updated terms.

# Privacy Policy

Last Updated: October 24, 2026

CustomsGuard ("we", "our", or "the Platform") is committed to safeguarding trade documentation and enterprise business intelligence.
This Privacy Policy outlines how shipping data, commercial documents, and user metadata are handled.

## 1. Scope and Information Processed
CustomsGuard processes trade documents uploaded or submitted via API or dashboard, including:
* Commercial invoices, packing lists, and bills of lading.
* Declared commodity descriptions, quantities, weights, and declared values.
* Declared Harmonized System (HS) codes and country of origin metadata.
* Corporate identifiers, port of origin, and destination facilities.

## 2. Confidentiality and PII Protection
* We enforce strict Personally Identifiable Information (PII) masking.
* Individual tax identification numbers, bank accounts, and personal contact details are automatically masked before LLM context ingestion.
* Customer commercial data is strictly partitioned and is never used to train public foundation models.

## 3. Storage and Data Retention
* Audit dossiers, generated evidence summaries, and itemized discrepancies are stored in client-designated storage locations (e.g., local reports archives).
* We retain audit logs solely for compliance tracking, verification history, and automated dossier exports.
* Customers maintain complete authority to purge or archive audit dossiers at any time.

## 4. Third-Party Integrations and Processing
* Audits processed via integrated orchestrators (such as Langflow, IBM Bob, or vector stores like Qdrant) transmit only the minimum trade attributes required for tariff lookup and compliance verification.
* Automated alert notifications dispatched via SMTP are routed exclusively to pre-configured recipient addresses.

## 5. Security Measures
CustomsGuard enforces container isolation, encrypted transit protocols, and local token authentication to ensure unauthorized entities cannot intercept shipment manifests or tariff calculations.

## 6. Inquiries and Compliance Contact
For privacy requests or inquiries regarding data protection policies, contact your designated trade compliance officer or email [email protected].
